Terms and Conditions for Kasama Tastings

These Terms and Conditions (“Terms”) explain the relationship between you (“Customer”) and Kasama Tastings (“Kasama Tastings,” “us,” our” or “we”) regarding your use of, and access to, our website located at kasamatastings.com (“Website”) and the features and functionality thereof (“Service” or “Event”). These Terms, which include our Privacy Policy, govern your access to and use of the Website, Service/Event and Content (as defined below), and constitute a binding legal agreement between you and Kasama Tastings.
YOU ACKNOWLEDGE AND AGREE THAT BY ACCESSING OR USING THE WEBSITE, OR BY DOWNLOADING OR POSTING ANY CONTENT FROM OR THROUGH THE WEBSITE, YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS.
Definitions
“Event” – Refers to the wine tasting services provided by Kasama Tastings.
“Customer” – The individual or entity booking and paying for the event.
“Guest(s)” – Individuals attending the event hosted by the Customer.
Event Duration and General Information
Duration: Wine tasting services typically last 1 to 1.5 hours, including set-up and clean-up.
Guest Count and Rates: Pricing varies based on the number of guests, with the option to add additional guests at an extra cost.
Remaining Wine: The Customer will retain any wine not served during the event.
Payment: Payment must be received at least one week prior to the requested reservation date to confirm booking. Final Payment can be made via Venmo or PayPal. All major credit cards are accepted through PayPal
Dietary Restrictions: Customers are responsible for informing Kasama Tastings of any dietary restrictions or allergies at least one week prior to the event. Kasama Tastings will make reasonable efforts to accommodate but cannot guarantee full compliance.
Special Requests: Any special requests (e.g., specific wine preferences, themes) must be communicated and confirmed in writing at least one week before the event.
Cancellation and Modifications
Unforeseen Cancellation
If the event is canceled due to dangerous situations, or conditions beyond the control of the Customer or Kasama Tastings (e.g., inclement weather, travel accidents, or similar unforeseen events), all parties agree to reschedule the event under the same terms as the original agreement.
If rescheduling is not possible within 6 months of the original event date, the event will be canceled. No refund will be issued for any deposits made, but no additional charges will apply.
If an event is interrupted or prevented from occurring for reasons stated above, Kasama Tastings is excused from its obligations. Kasama Tastings may provide a partial refund at its discretion, depending on costs already incurred. This refund, if offered, will be the Customer’s sole remedy.
Cancellation by Customer
If the Customer cancels the service more than 7 days before the event date, the Customer will receive a full refund.
Cancellations made within 7 days of the event will incur a charge of 50% of the total cost.
Rescheduling is treated as a cancellation, with replacement date terms subject to negotiation and possible additional costs.
For events without a specific date designated in the initial agreement, no refunds or credits are issued, and the full balance becomes due upon cancellation.
Cancellation by Kasama Tastings
Kasama Tastings reserves the right to cancel or adjust timing of the event at any time if conditions arise that could prevent the event from being safe or successful. In such cases, any fees paid will be refunded to the Customer, limiting Kasama Tastings’ liability to the amount of fees collected.
Until the Customer has signed and returned the agreement with all sections completed, this document serves only as a proposal and is not legally binding.
Acknowledgment of Risk and Liability
Liability Assumption: The Customer agrees to assume all liability and indemnify Kasama Tastings, its owners, contractors, and agents from any claims for damages, loss, or injury related to the event or the consumption of alcoholic beverages. The Customer confirms that all guests are 21 years of age or older.
Property Damage: The Customer agrees to reimburse Kasama Tastings for any damage to property caused by the Customer, their guests, or event attendees.
Intellectual Property
Event Recording: Audio and video recording by the Customer(s) is permitted only for personal, non-commercial purposes. Written consent is required for commercial use. Kasama Tastings may record or photograph the event and use these materials for marketing or promotional purposes.
Kasama Tastings Intellectual Property: The Customer acknowledges that Kasama Tastings shares proprietary information during the event. The Customer and guests have no rights to this intellectual property.
Additional Terms
Alcohol Responsibility: The Customer is responsible for ensuring the safe consumption of alcoholic beverages by guests.
Insurance: Kasama Tastings does not provide insurance for events. Customers are advised to secure their own liability insurance if necessary. Kasama Tastings’ total liability for any claims arising from or relating to the event is limited to the amount paid for the service.
Event Safety: Kasama Tastings reserves the right to halt or cancel the event if unsafe or inappropriate conditions arise.
Governing Law: These Terms and Conditions are governed by the laws of the state in which the event is held.
